A Texas jury on Friday found drug company Merck & Co. Inc. negligent in the death of a man taking the painkiller Vioxx and awarded his widow $253 million.
Following are key facts in the case:
** Charges - Robert Ernst died in 2001 six months after he began taking Vioxx, an arthritis drug made by Merck & Co.
** Award - $253 million, including $24 million for mental anguish and loss of companionship and $229 million in punitive damages. The verdict is certain to be reduced under Texas law and Merck has said it would appeal.
** Vioxx use - About 20 million people had been taking the pain killer when Merck voluntarily pulled it from shelves last September.
Vioxx contributed more than $2.5 billion in sales for Merck in 2003, about 10 percent of the company's total revenue.
** Vioxx affects - Prolonged use of the arthritis drug has been shown to double the risk of heart attack and stroke. Merck says Ernst died of arrhythmia, or irregular heartbeat, which has not been linked to Vioxx.
** Future cases - Over 4,200 Vioxx lawsuits have been filed in federal and state courts across the country, although Merck says only two have confirmed start dates.
